Section 5.11 Earned Personal Days: The cash-out option for unused Earned Personal Days has been eliminated, effective 9/1/09. Employees must take their Earned Personal Days as time off (within a certain time limit) or forfeit the day.
Section 5.9 Employee Transportation Reimbursement Account: Policy was revised to reflect changes in the administration of the employee transportation reimbursement program. The program will now be called “$martCommuter” and will be administered by Chard Snyder effective 01/01/2010.
Section 6.1 Fair Employment Rights and Responsibilities: The Fair Employment Rights and Responsibilities policy has always stated that employees must be treated fairly and shall be free from harassment, discrimination, and unfair treatment based on specified characteristics. The policy has been expanded to include characteristics related to sexual orientation.
Section 3.5 Overtime and Hours of Work/Hourly Employees: Due to revisions in ORC 4111.03 Overtime, Section E. was revised to bring policy into compliance with the law. Overtime is computed based upon hours actually worked (no longer based on hours in active pay status). Under Call-in Pay and On-Call, Section K. was revised to reflect this change. Changes are effective with the pay period beginning 10/1/09.
Section 7.2 Pre-Disciplinary Hearing: Clarification in Section A that pre-disciplinary conferences are only necessary when discipline may result in more than a 24-hour suspension for an FLSA non-exempt employee, or more than a 40-hour suspension for an FLSA exempt employee.
The following policies include revisions made necessary by the adoption of the Furlough Guidelines by the Board of County Commissioners. For benefits purposes, mandatory furlough hours are treated the same as hours in “active pay status,” and are excluded in the calculation for overtime.
Section 1.2 Definitions: “Active Pay Status” definition updated with the addition of administrative leave and earned personal days. A new definition was added for “Furlough.”
Section 4.1 Sick Leave: Section C. revised that employees earn sick leave for hours on mandatory furlough.
Section 5.0 Vacation: Section H. revised that mandatory furlough is counted the same as “earned pay” when determining vacation accrual.
Furlough Guidelines: Under Furlough Procedures section, clarification that hours on furlough are not utilized in the calculation for overtime.
Section 4.0 and SOP Family and Medical Leave: Revisions throughout the policy and SOP due to changes in the FMLA effective 01/16/09, including changes for leave related to family members of the military personnel.
Section 5.6 Retirement Participation/Benefits: Section M. authorizes the Certificate of Payout for Earned but Unused Sick and Vacation Leave form to be approved and signed by a designee of the County Administrator.
Section 5.7 Sick Leave Conversion: Sentence added at end of Section A. stating that special rules apply for employees who are reinstated from disability retirement and employees who have two concurrent positions with two public employers. Section F. authorizes the Certificate of Payout for Earned but Unused Sick and Vacation Leave form to be approved and signed by a designee of the County Administrator.
Section 5.2 Group Health Insurance Benefits: Section F. added regarding the spousal surcharge which became effective 01/01/09. Section H.3. was clarified regarding enrollment options when both an employee and his/her spouse are employed by Hamilton County. Section H.5. was modified to state that laid-off employees who are recalled to their same position or rehired into another position in the same department within 365 days will be eligible for benefits the first of the month following recall or rehire.
Section 5.11 Earned Personal Days: Policy was modified in Section D. to state that if an employee is on non-paid leave of absence as a result of being furloughed, that leave does not count against the employee in earning a personal day under this policy.
