Section 1 - Complaint for Divorce, Legal Separation, or Annulment

-Sections 1.1 to 1.7 provide forms for filing a Divorce, Legal Separation, or Annulment
-Sections 1.8 to 1.12 provide forms for filing an Answer to a Divorce, Legal Separation, or Annulment

 

FILING FEE:  August 3, 2015

–  $325.00 (without Children)

–  $375.00 (with Children)

All fees are payable by CASH, PERSONAL CHECK, CERTIFIED CHECK, MONEY ORDER, MASTERCARD, VISA, AMERICAN EXPRESS, or DISCOVER CARD.

Checks and Money Orders are to be made payable to: CLERK OF COURTS

REQUIRED COPIES: If you are using Certified Mail service or Regular Mail service you will need your original set of documents plus 3 copies of all documents. If you are using Sheriff's service, you will need your original set of documents plus 3 copies of all documents. If you are using the Publication process and posting, you will need your original set of documents plus 4 copies of all documents.

If there will be Shared Parenting in a case:
Shared Parenting Plans must be submitted at the Decree Office (room 3-50) and approved by the assigned Magistrate prior to the final hearing. To be  approved, the plan must be submitted with the following attachments: .

1. Appropriate Child Support Computation Worksheet (including deviation from guideline support amount, if appropriate). ODJFS Worksheet now available.

2. Standard Parenting Order (Form 2.7) If the said order is referenced in the body of the plan.

3. Appropriate health care order (Form 7.17 if private health insurance is available- Form 7.20 if not).

Shared Parenting Plans are generally approved or rejected within 5 business days, and can be picked up at the decree office (room 3-50).

Section 3 - Decree/Final Judgment of Divorce or Dissolution

REQUIRED COPIES: The Court will only need to keep the original Decree for our file. Certified copies can be ordered from and printed by the Clerk of Courts office .

Note that your marriage is not terminated until the Decree is filed with the Clerk of Courts. The Clerk of Court’s office will notify attorneys and unrepresented litigants via mailed postcard when the Decree is journalized. The date the Decree is journalized on the Clerk of Court’s docket is the date your marriage is officially terminated. Certified copies may be picked up in the Clerk of Courts office, room 3-47, after you receive the postcard.

Section 4 - Motions - Pre Decree

4.1 Contested Custody - Pre Decree

 

If parents are unable to agree regarding the permanent allocation of parental rights and responsibilities of their children, an investigation or Early Neutral Evaluation (ENE) may be required. The investigation may be initiated by: 1) a Decision or Order of the Magistrate, 2) an Order by the Judge or 3) an Agreed Entry between the parties. ENE may be initiated by: 1) an Entry Ordering Early Neutral Evaluation, 2) a Motion for Early Neutral Evaluation or 3) an Agreed Entry Early Neutral Evaluation.

A Brief Focused Investigation costing $400 will most likely be ordered in cases where all children involved are over 10 years of age. A Full Investigation costing $800 will most likely be ordered where one or all of the children involved are under 10 years of age. ENE costs $200.

In order to begin the investigation, the parties or their attorneys must deposit the appropriate fee with the Clerk of Courts in Room 3-47. A copy of the Entry Ordering Investigation (DR 2.5) and the completed Request For Services Form (DR 2.4) will be transferred by the courtroom staff to the Dispute Resolution Department in Room 3-001. A Social Worker/Counselor will investigate the case and make recommendations. All cases in which the allocation of parental rights and responsibilities are contested will be set for a pretrial conference before the assigned Judge. If after the pretrial conference, the case remains contested, the case will then be scheduled for a custody trial before the assigned Judge.

In order to begin ENE, the parties or their attorneys must schedule the ENE session and follow-up phone conference with the assigned Judge or Magistrate by going to the Docket Office in Room 3-46, at which time the ENE team (a Social Worker/Counselor and Magistrate) will be assigned to the case. The parties or their attorneys must also deposit the appropriate fee with the Clerk of Courts in Room 3-47.

4. A docket clerk will review all e-filed paperwork. If you fail to submit all required paperwork correctly and accurately, it may be rejected.
5. A docket clerk will contact you to schedule any required hearing.

1. Make sure all documents have been signed and notarized.

2. Once the Docket Office acknowledges the complete filing, you will go to the Clerk of Courts, Room 3-47 to pay any required fees.

  3. Documentation of overtime, commissions, and bonuses received during the three years immediately prior to the time when the person's child support obligation is being computed. A statement from an employer is an acceptable method of documentation, if a pay stub does not specify overtime, commissions or bonuses separately from wages.

COST: $125.00 for all issues.

Section 8 - Misc. Filings and Procedures

fdhh8.1 Objections to Magistrate's Decision and Motion to Set Aside Magistrate's

 

All Objections to Magistrate’s Decision (Form 8.9) shall be e-filed, sent via U.S. mail, or be presented to the Docket Office in Room 3-46. If requested, the date and time for the hearing before the assigned Judge will be scheduled at this time. If filing in person, the Docket Office will retain one copy of the Objection. The original Objection is then taken to the Clerk of Court’s Office in Room 3-47 for filing. It is counsel/party’s responsibility to serve the opposing side a copy of the Objections including the hearing date and time according to local procedure.

Motions To Set Aside Magistrate’s Order must first be e-filed, sent via U.S. mail, or presented to the Docket Office. If requested, a hearing date will be scheduled before the assigned Judge. If filing in person, the motion is then taken to the Clerk of Court’s Office in Room 3-47 for filing and service process.


8.2 Final Merits Hearing

 

A Final Merits Hearing will not be scheduled until all issues concerning property division, allocation of parental rights and responsibilities and support have been resolved either by agreement or court order. A "Request for Merit Setting" (Form No. 9.1) must be filed with the Court of Domestic Relations via e-filing, U.S. mail, or be presented to the Docket Office in Room 3-46 before a final hearing will be set.


8.3 Entry of Dismissal

 

When dismissing a pre-decree case, in its entirety, the original Entry of Dismissal shall be presented to the Clerk of Courts, via electronic filing or in person to allow for the costing out of the case. The clerk will note "Cost Paid" on the original and forward the document to the court for further processing. Remember to incorporate the appropriate language where child support, spousal support or any arrearage is involved.


8.4 Agreed Entry Appointing Court Appraiser

E-Filing:
1. Create an account with the Hamilton County Clerk of Courts office through their website: https://www.courtclerk.org/forms-filings/e-filing/.
2. Submit the Agreed Entry Appointing Appraiser (Form 11.1).
3. You will be prompted to enter your credit card information to pay any required fee.

U.S. Mail:
1. Submit the original document to the Hamilton County Court of Domestic Relations Docket Office for review.

1. Present the Agreed Entry Appointing Appraiser (Form 11.1) to the Docket Office, Room 3-46.

3. Go back to the Docket Office to submit Entry with the "COST PAID" stamp.

The Docket Office will appoint an appraiser. Once the appraisal has been completed, the appraiser will send the Court the original appraisal and the attorneys or parties (if unrepresented) their copy.

Section 9 - Petition to Register, Enforce or Modify Foreign Order

9.1 Registration and Enforcement of Foreign Support Order Pursuant to ORC 3115.601, et seq:

 

To register a Foreign Support Order:

A)     A support order or income-withholding order of another state or a foreign support order may be registered in this state by sending the following records to the appropriate tribunal in this state:

1.      A letter of transmittal to the tribunal requesting registration and enforcement;

2.      Two copies, including one certified copy, of the order to be registered, including any modification of the order;

3.      A sworn statement by the person requesting registration or a certified statement by the custodian of the records showing the amount of any arrearage;

4.      The name of the obligor and, if known, all of the following:

A.     The obligor’s address and social security number;

B.     The name and address of the obligor’s employer or other payor and any other source of income of the obligor;

C.     A description and the location of property of the obligor in this state not exempt from execution.

5.      Except as otherwise provided in section 3115.312 of the Revised Code, the name and address of the oblige and, if applicable, the person to whom support payments are remitted.

B)     On receipt of a request for a registration, the registering tribunal shall cause the order to be filed as an order of a tribunal of another state or a foreign support order, together with one copy of the documents and information, regardless of their form.

C)    A petition or comparable pleading seeking a remedy that must be affirmatively sought under other law of this state may be filed at the same time as request for registration or later. The pleading must specify the grounds for the remedy sought.

D)    If two or more orders are in effect, the person requesting registration shall do all of the following:

1.     Furnish to the tribunal a copy of every support order asserted to be in effect in addition to the documents specific in this section;

2.     Specify the order alleged to be the controlling order, if any; and

3.     Specify the amount of consolidate arrears, if any.

E)     A request for a determination of which is the controlling order may be filed separately or with a request for registration and enforcement or for registration and modification. The person requesting registration shall give notice of the request to each party whose rights may be affected by the determination.

    If enforcement or modification of the foreign support order is being sought, follow the above procedure PLUS prepare a Motion and requisite accompanying documents setting forth the relief sought. The Motion shall be e-filed, sent via U.S. mail, or  be presented to the Docket Office and the original Motion (after review by the Docket Office) is to be filed with the Clerk of Court. There will be a $125.00 cost for the Motion.


9.2 Registration and Enforcement of Foreign Decree Pursuant to ORC 3127.35:

 

To register a child custody determination:

A)     The clerk of a court with appropriate jurisdiction may register a child custody determination issued by a court of another state, with or without a simultaneous request for enforcement, on receipt of all of the following:

1.      A letter or other document requesting that the child custody determination be registered;

2.      Two copies, including one certified copy, of the determination sought to be registered, and a statement under penalty of perjury that, to the best of the knowledge and belief of the person seeking registration, the order has not been modified;

3.      Except as otherwise provided in section 3127.23 of the Revised Code, the name and address of the person seeking registration and any parent who is designated the residential parent and legal custodian of the child or to have parenting time with respect to the child or any person acting as a parent who has been awarded custody or visitation in the child custody determination sought to be registered;

4.      A filing fee of $75.00.

B)     On receipt of the documents and information required by division (A) of this section, the registering court shall do both of the following:

1.      Cause the child custody determination to be filed as a foreign judgment together with one copy of any accompanying documents and information, regardless of their form;

2.      Serve notice of the registration request on the persons named pursuant to division (A)(3) of this section, and provide them with an opportunity to contest the registration in accordance with this section.

3. Go back to the Docket Office to obtain a hearing date, if needed.
4. Return to the Clerk of Courts to indicate hearing date on service copy.

    If enforcement or modification of the foreign support order is being sought, follow the above procedure PLUS prepare a Motion and requisite accompanying documents setting forth the relief sought. A copy of the Motion must be provided to the Docket Office and the original Motion (after review by the Docket Office) is to be filed with the Clerk of Court. There will be a $125.00 cost for the Motion.  


Section 10 - Married/Child Born Post-Divorce - Filing for Custody and/or Child Support

FILING FEE:  Effective March 22, 2019

REQUIRED COPIES: You will need your original set of documents plus 3 copies of all documents.

  1. If there will be Shared Parenting in a case:
    Shared Plans must be submitted at the Decree Office (room 2-29) and approved by the assigned Magistrate prior to the final hearing..  To be approved, the plan must be submitted with the following attachments:
    • Appropriate Child Support Computation Worksheet (including deviation from guideline support amount, if appropriate).
    • Standard Parenting Order (Form 2.7) IF the said order is referenced in the body of the plan.
    • Appropriate health care order (Form 7.17 if private health insurance is available- Form 7.20 if not).
    • Cash Medical Order (Form 7.24).

    Shared Plans are generally approved or rejected within 5 business days, and can be picked up at the Decree Office (room 2-29).

    PLEASE READ:

    ** Pursuant to O.R.C. 3109.053, in any filing or action for divorce, dissolution of marriage, legal separation, or annulment in which there are any minor children of the marriage, the parties must successfully complete a court-approved in-person or on-line parenting education course. Certification from the parenting education class is valid for two years. Parties must retake the class if certification has expired.
